    1. Agreement to These Terms

    These Terms of Service ("Terms") are an agreement between you and Luunai OÜ, registry code 17378814, a company registered in Estonia operating the Fixter service ("Fixter," "we," "us," or "our"). They apply when you create an account, use the Fixter service, or use our websites, including fixter.dev, app.fixter.dev, and docs.fixter.dev. By creating an account or using the service you agree to these Terms. If you use Fixter on behalf of a company, you confirm that you have the authority to accept these Terms for that company, and "you" then means the company. If you do not agree to these Terms, do not use the service.

    2. The Service

    Fixter is a monitoring platform for software teams. It stores logs, traces, and metrics that you send over OpenTelemetry, detects issues, delivers alerts, runs AI-assisted investigations, and lets you query your data in plain language over MCP from compatible tools such as Claude Code and Cursor. The exact features available to you depend on your plan.

    We are continuously improving the service and may add, change, or remove features over time. If a change materially reduces the core functionality of your paid plan, we will let you know in advance where reasonably possible.

    3. Accounts

    • You must provide accurate account information and keep it up to date
    • You are responsible for all activity under your account, including activity by team members you invite
    • You must keep your credentials and API keys confidential and tell us promptly at info@fixter.dev if you suspect unauthorized access
    • You must be at least 16 years old and legally able to enter into a contract to use the service

    4. Plans, Trials, and Billing

    • Plans: Fixter is offered in tiered plans, including a free plan and paid plans billed as a flat monthly subscription in EUR. Current plans, prices, and limits are described on our pricing page
    • Trial: new accounts may start with a limited-time trial of a paid plan. When the trial ends, your account moves to the free plan unless you subscribe to a paid plan
    • Billing: paid subscriptions renew monthly until cancelled. You can cancel at any time, and the cancellation takes effect at the end of the current billing period. Except where required by law, payments are non-refundable
    • Usage limits: each plan includes usage limits, such as data volume, retention, and the number of investigations. If you exceed them we may ask you to upgrade, or limit further usage until the next period
    • Price changes: we may change prices with at least 30 days' notice. Changes apply from your next billing period

    5. Your Data

    "Customer Data" means the telemetry you send to Fixter, such as logs, traces, and metrics, and other content you submit to the service. You own your Customer Data. You grant us the right to host, process, and analyze it as needed to provide the service, including to detect issues, deliver alerts, and run investigations you have access to under your plan.

    • You are responsible for the Customer Data you send, including having the right to send it and making sure it does not include data you are not allowed to share with us
    • Avoid sending data you do not need monitored, such as passwords, secrets, or payment card numbers, in your telemetry
    • You can delete your Customer Data by deleting your account or contacting us
    • How we handle personal data is described in our Privacy Policy

    6. Repository Access

    Some features work with your source code repository, for example when an investigation uses repository context or when Fixter opens a fix pull request through the GitHub integration. Repository access only happens when you connect it and grant permission. When Fixter clones a repository, it does so into an isolated environment, uses it only to work on the specific investigation or fix at hand, and deletes the clone when that work is done.

    7. Acceptable Use

    You agree not to:

    • Use the service for anything unlawful, or send data you have no right to send
    • Interfere with or disrupt the service, or attempt to access other customers' data
    • Probe, scan, or test the vulnerability of the service without our written permission
    • Resell the service or offer it to third parties as your own, without our agreement
    • Reverse engineer the service, except where the law allows it despite this restriction
    • Use the service to build a directly competing product

    8. AI-Generated Output

    Parts of the service use AI, including issue detection, investigations, root cause analysis, and suggested fixes. AI output can be wrong or incomplete. Investigations and suggested fixes are provided to help you, not to replace your judgment. You are responsible for reviewing any analysis or code change before relying on it or applying it to your systems.

    9. Beta Features

    We may make features available in beta or early access. Beta features are provided as-is, may change or be withdrawn at any time, and may have separate limits. Use them at your own discretion.

    10. Intellectual Property

    We own the service, including its software, design, and documentation. These Terms do not transfer any of our intellectual property to you, and you do not transfer ownership of your Customer Data or your code to us. If you give us feedback or suggestions, we may use them without obligation to you.

    11. Third-Party Services

    The service integrates with third-party products such as GitHub, Slack, and MCP clients like Claude Code and Cursor. Those products are governed by their own terms, and we are not responsible for them. Connecting a third-party service is your choice and can be disconnected by you at any time.

    12. Disclaimer of Warranties

    The service is provided "as is" and "as available." To the fullest extent permitted by law, we disclaim all warranties, express or implied, including merchantability, fitness for a particular purpose, and non-infringement. We do not warrant that the service will be uninterrupted, error-free, or that it will detect every issue in your systems. Fixter is a monitoring and investigation tool; it does not guarantee the availability or correctness of your own systems.

    13. Limitation of Liability

    To the fullest extent permitted by law, neither party is liable for indirect, incidental, special, consequential, or punitive damages, or for lost profits, revenue, or data, even if advised of the possibility. Our total liability arising out of or related to the service is limited to the amounts you paid us in the 12 months before the event giving rise to the claim, or 100 EUR if you have not paid us anything. Nothing in these Terms limits liability that cannot be limited by law.

    14. Indemnification

    You will indemnify and hold us harmless from claims by third parties arising out of your Customer Data, your use of the service in violation of these Terms, or your violation of applicable law.

    15. Suspension and Termination

    • You can stop using the service and delete your account at any time
    • We may suspend or terminate your access if you materially breach these Terms, if your usage threatens the security or stability of the service, or if we are required to by law. Where reasonable, we will notify you and give you a chance to fix the problem first
    • After termination we will delete your Customer Data within a reasonable period, except where we are required to keep it by law
    • Sections that by their nature should survive termination do survive, including ownership, disclaimers, limitation of liability, and governing law

    16. Changes to These Terms

    We may update these Terms from time to time. When we make material changes, we will revise the "Last Updated" date above and, where appropriate, notify you by email or in the service. If you continue using the service after a change takes effect, you accept the updated Terms.

    17. Governing Law

    These Terms are governed by the laws of Estonia, without regard to its conflict of law rules. Any disputes will be resolved in the courts of Estonia, with Harju County Court in Tallinn as the court of first instance, and both parties consent to that venue. Before starting any formal proceeding, contact us and we will try to resolve the issue informally first.
